TERMS AND CONDITIONS

In these terms and conditions, "we" and "us" means GreekDateline.com, which is a trading name and trademark of GreekDateline.com.

GreekDateline.com is registered with the Data Protection Commissioner under the Data Protection Act 1998.

"You, Your, Yourself" means the person whose application for membership of the Service is accepted by Us.

"Agreement" means the agreement between You and Us incorporating these conditions for the provision of the Service;

"Member" means any person whose profile has been posted and been accepted by Us and whose membership remains valid for the time being;

"Post" means display, exhibit, publish, distribute, transmit and/or disclose information, details and/or other material on the Service, and the phrases "Posted" and "Posting" shall be constructed accordingly;

"Profile" means the section containing details, photographs and/or information about You composed and Posted by You;

"Service" means the service provided by Us to You including, but not limited to, Us allowing You to browse the Web Site, contact and/or be contacted by other Members through the Web Site and/or Post information on the Web Site;

"User" means any person who browses the Web Site.

1. You must be at least 18 years old to register.

2. By applying to register, you agree to abide to the terms of the agreement (as amended by us from time to time) between you and GreekDateline.com.

3. We have a right to vary the terms and conditions at any time. Any amendments to the agreement are notified to you by posting on the Terms and Conditions page of the Web Site.

4. We have a right to refuse registration applications for membership or to terminate memberships at any time. No application for membership is deemed to be accepted by us until you have received confirmation of the acceptance of your application for membership from us by email.

5. We have a right to make changes to the service if required to comply with legal reasons or other regulations as long as those changes do not a material adverse impact on the quality of the service.

6. The price that applies to the provision of the service is shown on our Help and Information page on the Web Site. Any changes will be shown on our Help and Information page on the Web Site.

7. You will not be able to contact other members or read and reply to other members' messages until we have received payment.

8. Prices include any applicable VAT and any details given in relation to exchange rates are approximate only and may vary from time to time.

9. Payment of all monies due to us are made by the means of payment specified on the Web Site and without any deduction, set-off, counterclaim or other withholding of monies. Any applicable banking charges on those payments are borne by us.

10. Payment shall not be deemed to be made until we have received cleared funds in respect of the full amount outstanding.

11. Either party may terminate the agreement at any time, for any reason. Termination of the agreement will be effective upon the terminating party sending written notice to the other party of their intentions. To terminate the agreement, the terminating party must complete the Delete your Profile form on the Web Site.

12. We may terminate the agreement immediately and/or immediately suspend and/or terminate your access to the service without notice if you fail to make any payment to us when due; if you breach the terms of the agreement; if you fail to provide Us within the time limit requested by Us with sufficient information to enable Us to determine the accuracy and/or validity of any information Posted by You; if in our opinion any information posted by you is damaging (or potentially damaging) to the interests of our business. This right may be exercised without prejudice to any other remedies to exercise any or all of our rights.

13. If we exercise any rights included in 12, all monies owed by you to us shall become immediately due and payable.

14. No monies paid are refundable on cancellation or termination of the agreement by either you or us at any time or for any reason.

15. We have a right to monitor, review and to amend or remove any information, photograph or other material posted by in the public areas of GreekDateline.com for any reason.

16. You will not post any personal details (such as your telephone number, address, email address or URL) in your profile or any other information that would enable other members or users to contact you directly.

17. You will not post any information, photographs and/or other material that breaches, violates, infringes and/or is against any law, by-law, statute and/or regulation or any other parties' rights (including intellectual Property rights and/or privacy rights, without that party's written permission).

18. If you post and/or disclose to other users any confidential information about you, then you do so entirely at your own risk.

19. If you arrange any meetings with any person through your use of the service, then you do so at your own risk. You should take any precautions to ensure your safety.

20. You will not use the service to promote another site, service and/or business in any way including posting any personal email addresses, URLs and/or other personal telephone numbers in your Profile.

21. You will not post any chain letters and/or any junk email to other members.

22. You will not post and/or email to another member any information, pictures and/or other material which in our opinion is sexually explicit, racist, abusive, threatening, sexually suggestive, libellous and/or obscene.

23. You will not post and/or email to another member any information, pictures and/or other material, which in our opinion is capable of offending other users' political and/or religious beliefs.

24. You will not solicit other Members' business, buy or sell products and/or services through the service.

25. You will not misuse in any way the service or any information posted on the service.

26. You warrant that you have taken all reasonable precautions to ensure that any data you upload or otherwise submit to the Website is free from viruses and anything else that may have a contaminating or destructive effect on any part of the Website or any other technology.

27. You will not attempt to gain unauthorised access to any information available on the service or to any networks used by the service.

28. You will not assign or transfer, part with and/or authorise any other person to use your membership. Also, the username and password are personal to you and not transferable. You are responsible for any and all information posted on the Website by anyone using your username and password and any payments due for services accessed through the Website by anyone using your username and password. Any breach of security of a username and password should be notified to us immediately.

29. You will not copy any information on the web site (including, but not limited to any information contained in other Members' Profiles) other than for the purposes contemplated in this agreement.

30. Other users will be able to view your profile.

31. You will be able to view the profiles of other members.

32. You warrant and represent to us that all information posted by you is accurate, true, complete and non-misleading and you will regularly update it so that it remains accurate, true, complete and non-misleading.

33. By submitting Content to any Interactive Area, you automatically grant and/or warrant that the owner of such Content, whether it be You or a third party, has expressly granted to the Number One Personals the royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, sublicense, distribute, perform, and display such Content, in whole or in part, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Intellectual Property Rights that may exist in such Content.

34. You waive absolutely any and all moral rights to be identified as author of your profile and any similar rights in any jurisdiction.

35. We own all intellectual property rights in the service absolutely.

36. The copyright of the material contained in the Website, together with the Website design, text and graphics and their selection and arrangement and all software compilations, underlying source code and software (including applets) belongs to GreekDateline.com Ltd and its subsidiaries. All rights are reserved. None of this material may be reproduced or redistributed without our written permission. You may, however, download or print a single copy for your own non- commercial off-line viewing.

37. We will use our reasonable commercial efforts to keep your personal details such as username, real email address and credit card numbers (where relevant) confidential and we will not disclose such information, except where such information is public knowledge or it is required to be disclosed by law. 38. We use cookies so that we can personalise your experience of the Website. If you set up your browser to reject the cookie, you may still use the Website. 39. The service is provided in its current form and we do not guarantee that the service will meet your requirements, purpose and/or expectations. Service interrupts, missing links or pages, inaccessible periods, database and error messages may appear at any time.

40. We will endeavour to allow uninterrupted access to the service but we assume no responsibility in respect of the availability and/or uninterrupted use of the service or for any delay in performance of the service. We shall have no Liability to You for any delay in performance of this Service and/or any other matters including any communications line failure, error and omission to the extent that such events and/or matters are due to any events outside Our reasonable control including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

41. GreekDateline.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the GreekDateline.com site or in connection with the GreekDateline.com Service.

42. GreekDateline.com guarantees that mailbox messages sent by members will be processed by the GreekDateline.com system and sent to the recipient. Notwithstanding, GreekDateline.com does not guarantee a response from the recipient nor does it make any other promises or warranties of any kind.

43. We shall have no liability for any defect in the service caused or contributed to by any member.

44. We shall have no liability to you arising out of any members' or unauthorised users' misuse of the information and/or other material posted by you on the service and/or to other members.

45. We do not warrant or represent (whether express or implied) that any data and information you supply to the Service will be accurate, complete, timely or correct. We have no obligation to verify any information included in any profile. We shall have no liability to you arising out of your use of the service and/or your reliance on any information an/or material posted on the service or posted to you by other members.

46. We assume no responsibility for the contents of any other websites to which the Website has links.

47. We shall have no liability to you under any circumstances including negligence, for any direct, indirect, incidental, special or consequential losses to you or to any other person (including economic, damage to reputation, damage to goodwill, loss of data, loss of programs, service interruptions, cost of procurement of substitute services) that result from the use or inability to use the GreekDateline.com service, any changes to the service, unauthorised access to the service or alteration of your transmission or data or from any material or data sent or received or not sent or received or from any transactions entered into through the service even if GreekDaateline.com know or have been advised of the possibility of such losses/ damages.

48. Our total Liability to You under and/or arising in relation to any Contract , will at all times be limited to the amount paid, if any, by you to GreekDateline.com for the service during the term of membership.

49. We shall have no liability to you to the extent that you are covered by any policy of insurance and you shall ensure that your insurers waive any and all rights of subrogation they may have against us.

50. GreekDateline.com does not screen the members registering to the service. As such, GreekDateline.com cannot be held responsible for any damages, direct, indirect, incidental and/or consequential arising out of the use of the service, including without limitation, to damages arising out of communication and/or meeting with other members of the service, or introduced to you via the GreekDateline.com service. Such damages include without limitation, physical damages, bodily injuries and/or emotional distress and discomfort.

51. You are solely responsible for the content of all materials you post on the GreekDateline.com service and in your private mailbox messages. Email messages sent between you and other members that are not readily accessible to the general public will be treated as private by GreekDateline.com to the extent required by applicable law.

52. You shall give us a reasonable opportunity to remedy any matter for which we are liable, before you incur any costs in remedying the matter yourself. If you do not do so, we shall have no liability to you.

53. You shall produce to us written evidence of any claims for which it is alleged that we are liable, together with written details of loss caused by us and the steps you have taken to mitigate the loss before we shall have any liability for the claim by you.

54. You shall be under a duty to mitigate any loss, damage, costs or expenses that You may suffer.

55. Nothing in this Agreement shall exclude or limit Our Liability for death or personal injury due to Our negligence or any Liability which is due to Our fraud or any other Liability which We are not permitted to exclude or limit as a matter of law.

56. Nothing in this Contract shall exclude or limit any of Your statutory rights which may not be excluded or limited due to You acting as a consumer.

57. No third parties shall have a right to enforce this agreement. Any right of a third party to enforce this agreement may be varied and/or extinguished without the consent of any such third party.

58. No waiver by us of any breach of this agreement shall be considered as a waiver of any subsequent breach of the same provision or any other provision.

59. If any provision of these terms and conditions is held to be unlawful, invalid or unforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.

60. This agreement is governed by and construed in accordance with English law and any disputes shall be subject to the exclusive jurisdiction of the English courts.

61. If you do not agree with the terms listed in this agreement, please do not register for the GreekDateline.com service.
